Florida is a no-fault state, which means after an accident, each driver files a claim with their own insurance company regardless of who caused the crash. Your Personal Injury Protection (PIP) coverage pays your medical bills and a portion of lost wages — up to your policy limit — without the need to prove who was at fault.
Florida requires a minimum of $10,000 in PIP coverage and $10,000 in Property Damage Liability (PDL). Florida does not require bodily injury liability coverage — a notable gap that leaves many Florida drivers exposed.
What Florida PIP Covers
Florida PIP covers 80% of necessary medical expenses and 60% of lost wages, up to the $10,000 limit. If your injuries are not an emergency medical condition, PIP only pays 80% of the first $2,500. The system is designed to provide quick payment for minor injuries without litigation.
PIP does not cover pain and suffering. To pursue a pain and suffering claim against an at-fault driver, your injuries must meet the serious injury threshold: significant scarring or disfigurement, permanent limitation of function, or 90 days of disability.
What Most Florida Drivers Are Missing
Florida does not require bodily injury liability coverage — meaning you could injure another driver and have no insurance to pay their damages. An estimated 20% of Florida drivers have no bodily injury liability coverage. VKOVR strongly recommends Florida drivers carry bodily injury liability (100/300 minimum), uninsured motorist coverage, and collision and comprehensive.
