New York State law requires all employers — including those with just one part-time employee — to carry workers' compensation insurance. This applies to for-profit and not-for-profit organizations, sole proprietors with employees, and out-of-state employers whose employees work in New York.
Failure to carry required workers' compensation coverage is a criminal offense in New York. Penalties include fines of $1,000–$2,000 per 10-day period of non-compliance for the first violation, and $2,000–$5,000 for subsequent violations. New York Disability Benefits Insurance
In addition to workers' compensation, New York requires most employers to carry Disability Benefits Insurance (DBL) to provide short-term wage replacement for employees who cannot work due to a non-work-related illness or injury.
